UPDATE ABOUT 24 HOUR OPEN-AIR PUBLIC MTG.& MUSICAL PERFORMANCE

On Dec.19th, at 3:45pm, a 24 hour Open-Air Public Mtg. and Musical Performance was declared at City Hall. Although proper protocol of city ordinance was being followed, there were some difficulties getting the city to allow it. Finally, they did recognize that citizens were in compliance, as one participant read aloud Winston-Salem Ordinance Sec. 38-3-Open air meetings (d) and the city’s own written definition “to include the delivery of a public address, lecture, sermon or discourse, or the conducting of a public musical or theatrical performance”.

Later, at the W-S City Council meeting, there was discussion about changing City Hall property from public to private property. Some council members expressed concerns about needing input from the public prior to making such a decision, so it will be discussed again in early January.

While the city council meeting transpired, citizens continued to converse on a small, grassy area of City Hall lawn that had been roped off by officials. Throughout the evening and into the early morning hours, participants discussed issues, ideas and opinions as well as performed music, political satire and theatrical oral readings. Evening communication overall was positive with the police, even though they confiscated the 99% banner and said it would not be returned. In addition, the police had allowed the same banner to be used on Sat. Dec. 17 and Sun. Dec.18, The police took the banner into “evidence” and issued a warning because they said participants were breaking an ordinance as banners are not allowed downtown during the month of December. It should be noted individuals had complied with moving the banner half an hour earlier, at the request of police.

At approximately 8:45 am this morning, the Winston-Salem Police Department told individuals on City Hall lawn that their meeting did not match the city’s interpretation of 38-3-(d) and were given verbal trespassing warnings. They were told they would be arrested if they did not leave the lawn of City Hall. The police would not discuss why they were out of compliance of the “open-air meeting”. Participants left the public property, as they gathered chairs, guitars, notebooks, food, art supplies, posters, a cardboard box of trash, clarinet, flute, tambourine, a tarp and other personal belongings.

After leaving City Hall Lawn, one individual, who says his legal rights to free speech and assembly were violated, was arrested. According to eye witnesses, he did comply with police directive to leave City Hall public property, but he was pushed against the brick wall on the sidewalk and handcuffed for yelling profanity at the police.

PLEASE BE AWARE THAT INDIVIDUALS INVOLVED WITH THIS INCIDENT ARE ADVISED NOT TO GO TO CITY HALL PROPERTY FOR 30  DAYS AS CONSULTATION WITH COUNSEL CONTINUES AND CONCERNS ARE DISCUSSED AT A PUBLIC MEETING.

This is a sad and unfortunate day for Winston Salem. While we are deeply disappointed  by the actions of the police,  we shall overcome…

THE CITY OF WS AND THE WS POLICE DEPT. HAVE FINALLY ACKNOWLEDGED

THE OPEN AIR PUBLIC MEETING AND PUBLIC MUSICAL PERFORMANCE AT 101 NORTH MAIN STREET-CITY HALL

Please do not sleep in sleeping bags to keep warm-sorry, the city says that’s illegal. And, of course, no tents, as that is considered camping and illegal as well.

If you can’t make the meeting, please just drop by to say hello, enjoy the public musical performance, beep your horns or bring food and/or coffee.

PARTICIPANTS WILL BE AWAKE ALL NIGHT LONG AND NEED YOU TO ATTEND!!

12/3 GA Mtg & Homeless Children’s Parade

Thanx to all who attended a lively GA meeting Sat; including many first time attendees who contributed several new exciting ideas and avenues to explore. Highlights included:

  • Consensus to rescind our request to the city for a physical Occupy location
  • Consensus to explore other Occupy options; including selected 24 hr occupies
  • Consensus to email WSJ re a restatement of our position on several key issues
  • Formulation of a group to look at ways to have OW-S help with local foreclosures

We also had 25+ members join in the parade to support homeless children. Despite some noteworthy obstacles, we were able to provide support, raise awareness and contribute a bountiful donation!

Hi all- Tonight at 7 pm at Krankies some of us will be meeting to discuss plans of action for the Veterans Day parade that we will be marching in on Friday, Nov. 11th.  Anyone who is interested in helping coordinate action for this event, please feel free to come to the meeting tonight at Krankies. Also, I called Krankies and confirmed our presence there (as they asked us to do last time we met there). They said it was fine but to be aware that their will be a jazz band playing there tonight seeing as every Monday is jazz night at Krankies. So it may be a little noisy in there. See you tonight.

Occupy Charlotte Needs Supplies

Occupy Charlotte needs dry goods such as rice and beans. They also need bottled water. If you have anything to donate, please bring items on Saturday Nov. 5th.  You can also drop them off at Krankies Coffee from 6- 7 p.m. on Thursday Nov. 3rd. Kim from Occupy will be there to collect food donations at Krankies on Thursday. Thanks for helping!!! See you Saturday!
